  1. Definitions

The sale of products offered on our website www.fineitalianeyewear.com (hereinafter referred to as “the Site”) is governed by the following General Conditions of Contract (hereinafter referred to as “the General Conditions”). 

The products offered on the Site are sold directly by Stiloptic di Celer Patrycja Ewa (hereinafter referred to as “Stiloptic”). 

Stiloptic is an Italian law company, with tax code CLRPRY85C56Z127I and VAT number 02266020037, registration number at the R.E.A. 199273, having its registered office at Via Nazionale 62D, 28831 Baveno (VB) – Italy. 

The purchase contract and related procedures are available in Italian and English.

  1. Introduction

2.1. The goods displayed on the Site are offered for sale to opticians once they have logged into the private area using a username and password, at a wholesale price not visible to the public. Additionally, these goods are also sold to private users at a final retail price. Purchase will only be possible if shipping to one of the following countries: Italy, European Countries, Switzerland (unless otherwise specified by agreement). 

2.2. Stiloptic may make changes or amendments to these General Conditions at any time. Therefore, customers will be required to accept only the General Conditions in effect at the time of their purchase. 

2.3. Customers are asked to carefully read these General Conditions which can also be viewed and downloaded at any time through the links on the homepage of the Site in accordance with article 3.7.

  1. Purchase

3.1. For each selected product, a web space displaying the photographic images of the item, the unit price, colors, and different sizes (where applicable) can be viewed. 

3.2. Each sale made by Stiloptic through the online sales service (the “Service”) may involve one or more products (hereinafter simply referred to as “Sale”). 

3.3. The customer selects items of interest, and the description of the products being sold, including measurements or sizes (where they exist), along with one or more digital photographic images that allow a correct representation of such products available on the Site, will be included in the customer’s Cart. 

3.4. Upon confirmation, the order will be sent directly to Stiloptic and to the customer. The purchase order will be stored in Stiloptic’s system. 

3.5. At the end of the purchasing procedure, it is recommended that the customer download, save, or print the General Conditions in force at the time the order is completed. The customer will also receive an email at the address provided in the purchase form, containing the confirmation of the main conditions of the purchase itself. 

3.6. Although Stiloptic constantly adopts measures to ensure that the photographs shown on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and color resolution features of the computer used by the customer. Consequently, Stiloptic will not be responsible for any inadequacy of the graphical representations of Fineitalianeyewear.com products shown on the Site if due to the aforementioned technical reasons. 

3.7. Stiloptic reserves the right to refuse orders from a customer with whom there is an ongoing legal dispute concerning a previous order. This applies equally in all cases where Stiloptic considers the customer unsuitable, including, by way of example, the case of previous breaches of contract conditions for online purchases on the Site or for any other legitimate reason, especially if the customer has been involved in fraudulent activities of any kind.

  1. Availability

4.1. The customer acknowledges that the stocks of products offered by Stiloptic through the Service are limited. 

4.2. Stiloptic reserves the right to change the items for sale on the Site at any time, without notice.

  1. Conclusion of the Order

5.1. The ordering procedure is complete when the customer selects the “Place Order” option. Upon confirmation, the order is sent to Stiloptic for processing and cannot be further modified or cancelled except in cases expressly contemplated in these General Conditions or as provided by applicable Italian law. 

5.2. The confirmation of the order constitutes proof of the customer’s acceptance of the provisions contained in these General Conditions. 

5.3. The data recorded on the Site are considered to constitute full proof of the details related to the transactions between Stiloptic and the customer. In the event of a dispute between Stiloptic and the customer concerning a transaction conducted through the Site, the data recorded by Stiloptic will be considered full proof of the transaction.

  1. Price and Payment Method

6.1. The prices of all B2B products offered for sale on the Site do not include VAT. 

6.2. The prices of products available for sale will be indicated in Euros (EUR). 

6.3. The total amount shown does not include shipping costs as specified below and shown in the Cart. Shipping costs are communicated to the customer upon official confirmation later sent by Stiloptic – ordini@stiloptic.com

6.4. Stiloptic reserves the right to change the prices of products offered for sale on the Site at any time and without notice. Customers will be charged the prices published on the Site at the time of the customer’s order confirmation, provided that the products ordered are available at that time. 

6.5. Stiloptic accepts payments exclusively as specified in the instructions on the invoice received together with the ordered goods. 

6.6. The shipment of the order takes place from 2 to 10 days from the date of receipt of the order. 

6.7. In case one or more products are unavailable, they will be shipped later without additional charges to the customer.

  1. Delivery

7.1. Shipping costs are indicated together with the other costs related to the purchase directly in the order confirmation and invoice. 

7.2. Stiloptic will do its best to deliver the ordered products as soon as possible and has the right to split an order into multiple shipments according to the availability of items. In such cases, Stiloptic will inform the customer by email or phone. In any case, shipping costs will be invoiced in full as if it were a single shipment. 

7.3. When the package with the ordered items leaves the Stiloptic warehouse, if possible, an email will be sent to the address indicated by the customer in the purchase form with the shipping code. This email will contain a tracking code and an exclusive link that allows real-time monitoring of the delivery. Our Customer Service will provide assistance for any possible issues related to the delivery; the customer can contact Stiloptic Customer Service by email at ordini@stiloptic.com

7.4. In case of delivery problems or delays of more than 10 (ten) working days after the order confirmation date, customers are required to report the matter to Stiloptic using the email address ordini@stiloptic.com.

  1. Order Compliance

8.1. At the time of delivery, the products must be checked to ensure that they correspond to the items ordered. 

8.2. Any anomalies found at delivery (for example, tampering or damage to the packaging, damaged products, items missing compared to the delivery slip, etc.) can be indicated directly on the delivery document in the form of handwritten comments signed by the customer. 

8.3. If the products do not match those ordered, the customer is required to promptly inform Stiloptic at the email address ordini@stiloptic.com and has the right to demand compliance of the order or, in the event of subsequent unavailability of the ordered products, to order different items of the same nature or, alternatively, to cancel the order.

  1. Returns and Refunds – Withdrawal

9.1. The exercise of the right to withdraw from an order by the customer and requests for returns and refunds for any item purchased on the Site must be made as described below: 

  1. a) Notifications regarding the potential return of products must be submitted within 8 (eight) days from the date of delivery of the items to the customer by sending a request to the following email addresses: ordini@stiloptic.com; info@stiloptic.com
  2. b) The customer must fill out and send the “return form” included in the package of their order specifying the reasons for the return and the quantity of items the customer wishes to return. This “return form” must be included in the return package. It is noted that returns will not be accepted for frames that do not include original sunglasses lenses and are not in their original intact packaging (decorative box – suede case – microfiber pouch – microfiber cloth – protective pouch – warranty).

9.3. Stiloptic will verify that the returned products are indeed in their original condition, reserving the right to demand compensation for any damage or discrepancy with the products delivered to the customer. Stiloptic will not be held liable in case of loss of returned products, shipments to incorrect addresses, or delays in the delivery of returned products, it being understood that the customer assumes all risks of such shipment.

  1. Liability for Defective Products

10.1. Stiloptic is liable for any defects in the Fine products sold on the Site, including non-compliance of the items with the products ordered, in accordance with Italian legislation and legislative decree no. 206 of September 6, 2005 (Consumer Code, concerning consumer protection, implementing the corresponding European Directives and, in particular, the principles and procedures established by the European Directive 1999/44/EC and subsequent updates, including legislative decree November 4, 2021, no. 170 and legislative decree March 7, 2023, no. 26). 

10.2. This warranty is valid provided both of the following conditions are met: a) the defect appears within 24 months from the date of delivery of the products; b) the customer submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by them. 

10.3. Specifically, under article 130 of the Consumer Code, in case of non-conformity, the customer will have the right to have the conformity of the products restored at no cost, through repair or replacement, or to obtain an appropriate price reduction or the termination of the contract relating to the disputed goods.

  1. Limitation of Liability

11.1. Stiloptic will not be liable for indirect or consequential damages and, in particular, disclaims any liability for lost profits resulting from the purchase of Stiloptic products through the Site.

  1. Disputes

12.1. These General Conditions are governed by Italian law and shall be interpreted in accordance with it, including Legislative Decree No. 206 of September 6, 2005 (Consumer Code), particularly referring to Title III [of Part III], Chapter I, Section II of the said Consumer Code, as well as Legislative Decree No. 70 of April 9, 2003 (regulations on electronic commerce), notwithstanding any different overriding mandatory rule of the country of habitual residence of the customer. 

12.2. In the event of a dispute, the court of the place of domicile or residence of the consumer according to the applicable law shall have jurisdiction, or, at the consumer’s choice in case of action taken by the consumer, the Court of Milan. 

12.3. Stiloptic reserves the right to make changes or amendments at any time to these General Conditions and the Privacy Policy. Such changes or amendments will be effective only in relation to purchase orders submitted after the date of the change or amendment.

SHIPPING 

Rates & Policy 

Fineitalianeyewear.com offers free shipping for all orders within the European Union and Switzerland. Typically, orders are delivered within 7 working days, depending on the destination country. 

Requests for orders to countries outside the European Union and Switzerland will be automatically canceled. 

Shipments to PO boxes are not allowed; orders with such addresses will be automatically canceled.

Shipping Tracking 

We will send you a confirmation email containing the courier details and the tracking number as soon as the order has been shipped.

Delivery 

It is recommended to check the condition of the goods upon delivery. If the goods are damaged or the packaging is open, you have the option to refuse the delivery or accept it with reservations.

RETURNS 

You have the option to withdraw from the contract and return any product purchased from Fineitalianeyewear.com for any reason within 14 days of receiving the shipment. Here are the steps to follow for a return:

  1. Ensure the product is complete with all original packaging elements, such as the decorative box, the suede case, the microfiber pouch, the microfiber cloth for cleaning the glasses, and the warranty. Items must be unused and undamaged, such as scratches or signs of wear.
  2. To initiate the return process, visit our website to complete the online return request or contact our customer service team.   3. We will provide you with a return authorization number (RA) that you must attach to your return package.
  4. After receiving the authorization, the purchased items must be sent within 14 days from the notification of your decision to withdraw from the contract.

The cost of the return shipment is borne by the sender and it is recommended to use a trackable shipment, as Fineitalianeyewear.com is not responsible for theft or loss during transport. 

5. Wait up to 10 working days for the refund to appear on your bank account. You will be contacted by our customer service to provide us with your IBAN.

Remember that items purchased from other authorized retailers must be returned to the original point of purchase.

 

WARRANTY

Warranty Policy

Fineitalianeyewear.com offers a warranty on its products to protect against breakages caused by material and manufacturing defects not visible to the naked eye, detected within two years from the date of delivery. This warranty is valid only for the original purchaser and requires the presentation of a proof of purchase, in accordance with Legislative Decree No. 24 of February 2, 2002, which implements Directive 99/44/EC. To make use of the Legal Warranty, the defect must be reported within two months of its discovery.

Exclusions from Stiloptic’s warranty coverage include:

  • Defects caused by improper or abusive use, alterations, repairs, or unauthorized manipulations.
  • Deformation and consequent breakage of hinges caused by accidents such as impact, crushing, or sitting on the glasses.
  • Deterioration of the enamel or paint due to use in extreme conditions.
  • Aging of the product due to the normal use of materials, such as scratches, chips, and marks.
  • Damage or alteration of color due to exposure to chemicals, such as detergents, hair spray, alcohol-containing perfumes, or makeup products. To report a manufacturing defect, contact our customer service team by sending an email to support@stiloptic.com, including your order number.

Missing or Defective Goods 

As soon as you receive your order, we invite you to check it immediately to ensure that everything meets your expectations. If you find that the order is incorrect, an item is missing, there is a material or manufacturing defect, or it is damaged, here is what to do:

  1. Contact our customer service team by sending an email to support@stiloptic.com. Include your order number in the message. It is important that you contact us within 14 days of receiving the package; after this period, we cannot take responsibility for the items in question.
  2. Fill the claim form and attach it with clear photos of the wrong or damaged item(s) you received to the email. Make sure to include the code of the glasses, which is usually found on the inside of the left temple, the delivery slip, and the package itself. 
  3. Specify in your communication whether you prefer to receive a replacement (confirming the delivery address) or a refund.

Returns are only accepted for items purchased directly from fineitalianeyewear.com. Items bought from authorized retailers must be returned to the original point of sale.
